RESOLUTION
TOWN CENTER METROPOLITAN DISTRICT POLICY ADDRESSING LIMITED DECORATION INSTALLATIONS ON DISTRICT PROPERTY
WHEREAS, the Town Center Metropolitan District (the "District") is a quasi-municipal corporation and political subdivision of the State of Colorado, organized and operating pursuant to Section 32-1-101 et seq., C.R.S. and other Colorado law; and
WHEREAS, the District was organized to serve a public purpose and to promote the health, safety, prosperity, security, and general welfare of the District's and other residents of the State of Colorado; and
WHEREAS, the Board of Directors of the District (the "Board") is empowered to have the management, control, and supervision of all the business and affairs of the District pursuant to Sections 29-1-201, 32-1-1001(1)(h), and 32-1-1101(1)(f), C.R.S.; and
WHEREAS, the District is entitled to fix and from time to time increase fees, rates, tolls, penalties, or charges for services, programs, or facilities it provides pursuant to Sections 32-1- 1001(1)(j)(I) and 32-1-1101(1)(f), C.R.S.; and
WHEREAS, the District owns certain lands and improvements within the District, some of which are in the vicinity of or adjacent to privately owned residences; and
WHEREAS, residents in the District have previously installed decorations on District property and improvements, and residents continue to request to install decorations on District property and improvements; and
WHEREAS, in the past, the District has taken the position that installation of decorations on District property, including fencing in the Green Valley Ranch community, should be prohibited; and
WHEREAS, the District has gathered information and input from various sources, including residents, consultants and other interested parties, regarding whether the District should revisit its policy prohibiting decorations, and amend the policy so as to permit installation of decorations on District property for a limited period each year subject to certain conditions outlined herein; and
WHEREAS, the District finds and determines that effective immediately upon adoption of this Resolution and until this Resolution is amended or repealed, it will not continue to enforce its prohibition on decorations on District property providing the decorations and activities related thereto conform to the requirements of this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Town Center Metropolitan District:
Period Decorations Permitted. Decorations may be temporarily installed on District property and improvements immediately adjacent to a resident's residential property commencing no earlier than November 15; and, the decorations shall be fully removed from District property and improvements no later than January 15th of the following year.
Location and Condition of Decorations. Decorations should be of reasonable size and number and should not unduly burden the underlying property or improvements. No decorations shall be located in the right-of-way nor shall any decorations impeded vehicle or pedestrian traffic. All decorations should be in good condition, not tattered or broken.
Duty to Restore. Any District property or improvements damaged by the placement of decorations shall be promptly repaired and restored to the condition existing prior to the installation of the decorations. Any damage not repaired within 30 days following removal of the decorations may be repaired by the District and charged to the owner or resident who installed the decorations. Any charges incurred by the District to repair damaged property shall be reimbursed ot the Districtwithin 30 days of delivery of an invoice. Any invoiced charges are, by statute, a first lien against the properties served, and may be collected ni the manner described ni Section 32-1-1001(1)(j)(I), C.R.S.
Amendment. TheDistrict may amend or repeal this Resolution at any time in the discretion of the Board.
Severability. Invalidation of any of the provisions of this Resolution or of any paragraph, sentence, clause, phrase, or word herein, or the application thereof in any given circumstance, shall not affect the validity of the remainder of this Resolution.
Effective Date This Resolution shall be effective immediately upon its adoption.
